To reserve your event date with Blue Media Works Multimedia (BMWM), follow these instructions: Read, complete, sign and submit this e-contract using the submit button at the bottom of the page. Once we receive your e-contract, BMWM will email two invoices. Your deposit invoice is due immediately. Your final payment invoice is due by the day of your event. Event date is not secure until we receive your deposit payment.

This agreement constitutes an order for wedding portraiture services, including the taking of wedding pictures as agreed to by both parties: Blue Media Works Photography and the client listed. Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain property of Blue Media Works Photography and may be used for advertising, marketing, display or any other purpose thought proper by Blue Media Works Photography.

The amount agreed upon covers the photographer’s time, talent, proofing and editing.

Blue Media Works Photography will choose the best images from the session (if applicable) and the wedding day. Blue Media Works Photography does not show un-edited images, nor involve the clients in the process of choosing which images will be chosen for the final gallery. Please rest assured that Blue Media Works Photography will only show you the BEST of the BEST and any images that are unappealing (i.e. eyes closed, unflattering facial expressions and most definitely, any images that do not meet Blue Media Works Photography's high professional standards will get deleted immediately).

The scheduled photographer with BMWP will be the official photographer for the event listed within this contract.

The scheduled photographer with BMWP will provide the client with a detailed photo list to help organize a photo schedule. This should be returned to the photographer no later than one week of the event listed within this contract.

Blue Media Works/Blue Media Works Photography (BMWP) will reserve and provide professional photography services (and products) as outlined within this contract based on the date, time and location provided by the client.

Deposit & Payment:
BMWP accepts checks, money orders, Visa, Master Card, Discover and American Express for payment of services.The client authorizes to convert check payments into an electronic funds transfer(EFT). In the event that the client’s EFT is unpaid, BMWP will access a fee of $30.00 or larger, as allowed by law, via EFT or draft.Payments can be made via: Phone: (800) 243-1445Online invoice: Invoices are supplied by BMWP once a contract is submitted. For invoice copies, email: customerservice@bluemediaworks.com.Mail: Blue Media Works, 20743 Cranfield Drive, Katy, TX 77450The client agrees to pay a deposit of $499 to retain a BMW photographer to perform the services specified within this contract. The deposit will be applied to services on the date and time listed within this contract. The client’s final payment for photography services is due by or on the date of event listed within this contract. If the client fails to pay the remaining balance on or before the due date, the client will be in default of this agreement and be subject to a late/default charge of $35 per week. BMWP reserves the right to remove online proofs for failure of payment.BMWP is not obligated to complete projects listed within this contract until outstanding payments are paid (including late/default charges).All deposits made for a scheduled event are nonrefundable unless otherwise stated within this contract.If outstanding payments are not paid within 60 days of the clients due date, BMWP reserves the right to file a claim within the county of clients residence.

Cancellation requests will only be accepted in writing from the client listed within this contract.
All cancellations regarding the event listed within this contract is subject to a cancellation fee of $650.00 + deposit. Deposits are nonrefundable. Any Prepayments (less deposit) will be applied to your cancellation fee. Cancellation fees are due within 5 days of cancellation request. Failure, on the part of the client, to pay any remaining balance within 5 days of cancellation, will result in a finance charges being added to the unpaid amount. The finance charge will be based on the rate of 1.5% per month. If cancellation fee and finance charge are not paid within 30 days of cancellation request, BMWP reserves the right to file a claim within the county of client’s residence.

It is the client's responsibility to adhere to Blue Media Works Photography's (BMWP) copyright policy.The client is personally responsible for communicating the limitations of BMWP's copyright policy to any person who receives media taken within the event of client's contract.

Client UsagePrints:
BMWP authorizes the client to process and reproduce prints using the images taken within the event of this contract, for personal use only.

Commercial Use:
BMWP does not authorize making copies for sale, or for the purpose of circumventing sale of our photos/media. BMWP does not authorize any image for commercial use.

Social Media:
BMWP authorizes the client to display photos on social media sites with a credit statement of “© Blue Media Works Photography www.bluemediaworks.com”.

Print/Newspaper/Publications:
BMW authorizes client to reproduce images in publications with a credit statement of "www.bluemediaworksphotography.com above or below each published image.

Flash Drives:
BMWP does not grant authorization to duplicate, manipulate or distribute our photo disks/flash drives or copies of our photo disks/flash drives.

Photo Books & Folio Books:
Your wedding photography package includes a 20 side (10 page), leather folio (as listed in the package description). This folio book can be ordered from BMWP's proofing site. It is clients responsibility to use BMWP's pre-created templates to create their book on their own. BMWP will provide a coupon code for checkout that will cover printing cost (not creative services or products of those services) Coupon code will expire one year from event date. BMWP is not responsible for creating custom folios.

Photo credits are included in every package and may be applied on products (not services or products of those services) at BMWM proofing site www.mypictures.co. Credits may be not be applied to professional services, design fees or custom products of professional services. Credits are not redeemable for cash.

BMWP will make digital proofs available to the client for the purposes of selecting proofs. Proofs are not intended for reprinting or virtual saving.

BMWP Usage
BMWP is the copyright owner of all digital media and has the exclusive right to make reproductions, unless otherwise agreed upon in writing.
BMWP reserves the right to use any digital or print media for advertising, portfolios, print samples, photographic contest, art exhibitions, and editorial use or for studio use.

All disputes arising under this agreement should be submitted to binding arbitration within 30 days of the client’s event date and the arbitration process should be filed, processed and take place in the state of Texas. The arbitration award may be entered for judgment in any court having jurisdiction thereof.

If BMWP cannot perform this agreement due to fire, flood, act of God (including adverse weather) or causes beyond the control of BMWP, or due to the scheduled photographer illness, BMWP will return any amounts collected as a deposit to the client but will have no further liability with respect to this contract. This limitation on liability also applies in the event that photographic materials or media are damaged in processing, stolen or lost through camera malfunction, lost in shipping, or otherwise lost or damaged without fault on the part of BMWP. In the event that the scheduled photographer with BMWP fails to perform for any other reason, BMWP shall not be liable for any amount in excess of the retail value of the client’s contract.
